Mass. SJC tosses out murder conviction for getaway driver in Charlestown shooting [Video]

The Massachusetts Supreme Judicial Court on Tuesday overturned a first-degree murder conviction against a man who prosecutors say was the getaway driver in a fatal November 2014 shooting in the Charlestown section of Boston. The court found there was no evidence to suggest the man intended for the victim to be killed.

Julio Baez was convicted of first-degree murder, armed assault with intent to murder and assault and battery with a dangerous weapon on a joint venture theory where prosecutors accused him of aiding and abetting the crime. But the state’s highest court, in a unanimous decision, found there was insufficient evidence to suggest Baez knew that his co-defendants’ intent was to kill the victim, Ryan Morrissey, or even that they were armed with guns at the time.
