FDA battle over flavored vapes goes before the Supreme Court [Video]

WASHINGTON (Gray DC) – The Supreme Court heard oral arguments on Monday in a dispute over the Food and Drug Administration’s decision to not approve flavored vaping products over concerns for the public health.

The agency has refused to approve applications for the sale of new flavored vaping products because they say could encourage young people to move tobacco.

Under a 2009 law, manufacturers of tobacco products must show when applying for marketing of new products would be “appropriate for the protection of public health.”

The FDA has said it denied applications for flavored vaping products because the manufacturers failed to show that their benefits outweighed their harms.

The companies argue that the FDA unfairly changed their requirements for approving new products in the middle of the process.
